What is an industrial design?

From a legal point of view, an industrial design is a decision on the appearance of a product.

An industrial design is the result of a person’s creative activity in the field of artistic design.

  • An industrial design can have spatial features such as shape or volume, and two-dimensional features such as pattern, line, or color.
  • Industrial designs are used in a wide range of industrial and craft products, whether packaging or containers, furniture and household items or lighting fixtures and decorations, electrical appliances or textiles. Industrial designs can also apply to graphic symbols, graphical user interfaces and logos.
  • An industrial design is a combination of functional and external features. An industrial design, whether it is an artistic design of a table or a telephone, is one of the key factors that draw our attention to a product or make us prefer one of the products.
  • The acquisition of rights to a registered industrial design is evidenced by a certificate. Legal protection is granted to an industrial design that does not contradict public order, generally recognized principles of morality and meets the criteria for protection.
  • An industrial design meets the criteria for protection if it is new and has an individual character.
  • An industrial design is recognized as new if no identical industrial design has been brought to public notice before the date of submission of the application to the Ukrpatent or, if priority is claimed, before the date of its priority.
  • Industrial designs are considered identical if their essential features differ only in minor details.
  • An industrial design is recognized as having an individual character if the general impression it makes on an informed user differs from the general impression made on such a user by any other industrial design brought to public notice before the date of application to the Ukrpatent or, if priority is claimed, before its priority date.

The owner of an industrial design has the exclusive right:

  • to use the industrial design at its discretion, if such use does not violate the rights of other persons;
  • prohibit other persons from using the industrial design without his permission (except when such use is not recognized by the Law violation of industrial design rights).

To obtain a certificate for an industrial design, it is necessary to submit it correctly completed application.

An industrial design is protected only in the country in which it is registered.

The Hague system of international registration of industrial designs allows the owner of an industrial design to secure the protection of his development in several countries by filing a single application in one language with the payment of one set of filing fees.
